The Rajasthan High Court recently ordered the state to release a criminal from a Below Poverty Line (B.P.L.) family on a seven-day parole after he posted a personal bond of Rs. 2,00,000/- and one sound and solvent surety of Rs. 1,00,000/-.The court did, however, eliminate the requirement that the petitioner’s brother deposit a surety bond.
On 29.09.2021, the petitioner was granted 7-day release under Rule 18 of the Rajasthan Prisoners Release on Parole Rules, 1958, with the condition that he deposit a personal bond of Rs.2,00,000/- and two sureties of Rs.1,00,000/- each.
The petitioner, represented by Adv. Naresh Charaniya and Adv. Kaluram Bhati, had petitioned the High Court with the claim that he could be released on personal bail only because he is a poor man from the B.P.L. family.
Justice Sandeep Mehta and Justice Rameshwar Vyas, sitting as a division bench, voiced their displeasure at the convict’s release on a personal bond. It was noted:
“In accordance with the prevailing facts and circumstances as they appear on the record, we are hesitant to grant the petitioner’s request for parole based only on the provision of a personal bond. However, the conditions of the order dated September 29, 2021 are relaxed, and it is directed that the petitioner be released on a seven-day parole after depositing a personal bond of Rs. 2,00,000/- and one sound and solvent surety of Rs. 1,00,000/-. The petitioner’s brother’s requirement to deposit a surety bond has been waived. The order’s additional requirements, dated September 29, 2021, are upheld.”
