The Supreme Court on Monday rejected to hear a case filed by All India Tours Corporation seeking directions to the Union of India to regard it as a Private Tour Operator (PT) for the Hajj in 2022 and to add its name to the list of Hajj Group Organizers (HGOs) for the Hajj in 2022.
A bench of Justices Abdul Nazeer and Pamidighantam Sri Narasimha refused to hear the Al Islam Tour Corporations’ petition.
Following that, the petitioner requested permission to withdraw his plea and file a motion with the concerned High Court. The petitioner was given the freedom to pursue any alternative legal remedy accessible to him.
Justice Nazeer said during the hearing that “We have already dismissed petitions. The Hajj programme has already begun. Read over our previous orders. How much time do you have left for Hajj? At the very least, you should have arrived a month in advance “.
The petitioner, who arranges Haj, Umrah, and Ziyatrat Tours, claims that the approval of its application form for registration and allocation of Haj quota for Haj-2022 has been placed on hold, despite the fact that they applied online and met all of the Haj Committee of India’s eligibility criteria.
According to the appeal filed by Advocate Md Shahid Anwar, the respondent awarded the petitioner a certificate of registration of Haj Group Organizers for Haj-2019 on June 4, 2019, and allotted a total quota of 50 pilgrims.
On the 12th of March 2020, the petitioner was served with a show cause notice based on an allegation made by one Shri Muzammil Khan, and the petitioner was asked why its security deposited with the respondent should not be forfeited and why the petitioner should not be blacklisted.
The petitioner responded on March 18, 2020, stating that the charges are untrue and founded on completely incorrect facts, and that they should be invalidated.
According to the petitioner, the respondent learned that final lists of HGOs for Haj-2022 were generated by the respondent without the petitioner’s name and that a list of blacklisted HGOs was also prepared without the petitioner’s name.
